Full Terms and Conditions

Lotteries are a form of gambling and we encourage any persons entering any Lottery to gamble sensibly. For more advice on responsible gambling please see section 12 of these Rules.

  1. About the Lotteries
    1. These terms and conditions (the 'Rules') contain the rules for Your Lottery (a 'Lottery'). Any person entering a Lottery ('Entrant', 'you', 'your') will be bound by these Rules together with the general Terms and Conditions for the YourLottery.org website (the 'Website') and the Privacy Policy.
    2. The Lotteries are promoted by Communication Zap Ltd (the 'Promoter', 'we', 'our', 'us') to assist in the creation of amenities and facilities for sport, youth development in sport, charities, non profit organizations and community groups and other organisations that the Promoter supports from time to time.
    3. The Lotteries are licensed by the Wyre Borough Council under the Gambling Act 2005 Operating Licence number SL0338
  2. How to enter
    1. Entrants must be 16 years of age or over and resident in the UK. If, upon winning any prize in the Lottery, you are not able to prove you have met these requirements then you will not be entitled to receive that prize.
    2. Each single entry to a Lottery ('Entry') costs £5.
    3. Entries may be made directly with the Promoter or through one of the Promoter's registered agents (an 'Agent').
    4. Entrants may make up Entries per week up to a maximum of £20 and a Lottery Member or Entrant shall not be permitted to exceed this limit without the approval of the Promoter.
    5. Each Entrant must be registered by his or her full name and address.
    6. An Entry in the draw is only valid if the Entry has been fully paid for in time for the appropriate draw.
    7. It is the responsibility of each Entrant to ensure that his or her correct name and address has been recorded for his or her Entry and reference numbers and where appropriate the Agent has recorded the Entry as paid for the appropriate weeks draw. The Promoter cannot be held liable for losses occasioned as a result of incorrect Entrant information.
    8. In respect of collection sheets, a sheet not correctly marked, or left unmarked, will count as unsold. Any such Entries will not be eligible to be in the draw to win a prize.
    9. Any person who wishes to play a Lottery must register with the Promoter and open an account ('Lottery Account') by completing and submitting the registration form.
    10. Entries may be made on a 'pay per play' basis or Entrants may subscribe with a Lottery to pay for Entries regularly by direct debit. Entrants that subscribe to play a Lottery regularly are referred to in these Rules as 'Lottery Members'.
    11. New Lottery Members will be sent a welcome letter advising them of their unique personal membership number.
  3. How to win
    1. All Lottery Entry sales are final, and no refunds shall be made at any time. All Entrants acknowledge that their payment of their Entry does not guarantee that they will win any prize.
    2. Your Lottery: The draw for the Lottery will take place on the last Friday of every month at the Lottery Office or any other site as the Promoter may from time to may use at its sole discretion. Where possible Entrants to the draw may, if they wish, attend the draw and may be invited to participate in the draw.
      1. Each Entrant will be issued with 4 numbers in the range 1-72 that need to be matched in the order drawn to win jackpot or one of the guaranteed prizes.
      2. To win a prize in the main draw, the Entrant's numbers must match exactly the winning numbers drawn, in the same order.
      3. To win any bonus draw the 'lucky' numbers must match exactly the winning numbers drawn, in the same order.
      4. There are 13 monthly cash prizes with a monthly prize fund available of £1,600 plus a monthly jackpot of £10,000.
      5. Weekly guaranteed top prizes of £200 week 1, £250 week 2 and £1,000 week 3 plus runners up prizes of £50, £20, 8x £10.
      6. No prizes are shared and only subscriptions received prior to the draw will be entered into that draw.
      7. All numbers issued to Entrants are unique any alteration of numbers shown on membership cards will be considered void.
      8. OOf each £5 subscription received a maximum of 30% goes to administration and running costs (printing, bank charges, system costs, registration costs and salaries), at least 20% is paid out in prizes and a minimum of 50% would be received by the charity.
      9. The odds of winning any of the guaranteed prizes for each entry is approximately 1:123 which is based on the approximate number of entrants who choose to enter the lottery at one time. The promoter reserves the right to amend these odds from time to time.
      10. The odds on winning the £10,000 monthly jackpot is 1:1,028,790.
  4. Prize draw and notification
    1. All prizes will be paid directly to winners unless alternative arrangements have been made. Winners do not need to claim the prize. Cash prizes will be made payable to the Entrant only and may be awarded by cheque, direct debit or any other method used by the Promoter in its absolute discretion from time to time.
    2. Details of the winning Entries will be published each month on the Website and a copy of the result sheet is available on request. The Promoter will not be liable for any error, misprint or omission in the publication of the winning Entries and the official list of winners will be available for inspection at the Promoter's premises.
    3. Details of the winners will be announced on a monthly basis during the week following the draw.
    4. Prizes will be determined from time to time at the Promoter's discretion in line with the Gambling Commission Act 2005.
    5. Agents are considered to be acting on behalf of Entrants. The Promoter will not be liable for any loss or damage caused by the default, neglect or error of any Agent.
    6. The decision of the Promoter will be final and binding in respect of any dispute or difference arising out of the activities of a Lottery.
    7. Full payment for each Entry must be received in cash or cleared funds before the Entry is entered into the draw. Only Entries for which full payment has been received are eligible to win a prize.
    8. Entrants are solely responsible for providing the Promoter with their accurate and up-to-date contact details and the Promoter will be in no way liable for any failure or inability to contact any prize winner due to any errors, omissions or inaccuracies in the contact details that the Entrant has provided. In the event that an Entrant changes his or her contact details, he or she will be solely responsible for advising the Promoter of the change.
    9. By accepting the prize, the winner consents to take part in any promotional activity requested by the Promoter and the Promoter reserves the right to use the name and address of the winner, his or her photograph and audio and/or visual recordings of him or her in any publicity.
  5. Cancellation and termination
    1. Lottery Members may cancel their Lottery Account at any time by notifying the Promoter in one of the ways set out in Section 10. No refunds will be paid in respect of Entries which have already been paid for.
    2. No cancellation will be effective until the Promoter receives the Lottery Member's notice of cancellation.
    3. Entrants wishing to exclude themselves from the Lotteries can do so by contacting the Promoter but will not be able to rejoin the Lotteries for a period of 6 months from the date of self-exclusion.
    4. The Promoter may at any time cancel the Lottery Account of any Lottery Member and refuse to accept any further Entries from that Entrant if the Entrant is at any time in breach of these Rules. The Promoter will notify the Lottery Member accordingly as soon as reasonably practicable and will reimburse any amounts which have been paid but which relate to a further draw.
    5. The Promoter may, in its absolute discretion and at any time, suspend the Lottery and/or cancel the draw. During this time, the Promoter may suspend Direct Debit payments from Lottery Members' bank or building society accounts and/or elect to hold any funds received in respect of a Entries into a draw which has not taken place and apply these to any future draw.
    6. Where one of the events in clauses 5.4 or 5.5 occur, save in respect of sums received in relation to any draw which has not taken place, the Promoter shall not be liable for any loss or damage (including loss of the opportunity to enter the Lottery and/or the right to receive a prize) suffered by you in relation to such cancellation or suspension.
  6. Liability
    1. Nothing in these Rules shall exclude or limit any person's liability for fraud or fraudulent misrepresentation or for any other liability which it may not lawfully exclude or limit.
    2. Neither the Promoter nor Your Lottery shall in any circumstances be liable for any loss of any nature including loss of profits, indirect, special or consequential loss, suffered or incurred by any Entrant or Lottery Member or any other person arising from the withdrawal of any aspect of the Lotteries or from the participation or non-participation of any person in a Lottery, including the loss, for whatever reason, of the chance to participate in a Lottery.
    3. Neither the Promoter nor Your Lottery shall be liable to any Entrant or Lottery Member for any loss or damage suffered or arising from any delay or failure in delivering a prize to the winner, for any refusal by the Promoter to accept registration of an individual as a Lottery Member, for the cancellation of a Lottery Account or for any other event beyond the reasonable control of the Promoter and/or Everton.
  7. Privacy and data
    1. The Promoter is committed to protecting the privacy of all Entrants and Lottery Members. Data that is collected from or about Entrants or Lottery Members ('Data') will be processed lawfully and in accordance with the General Data Protection Regulation (Regulation (EU) 2016/679) and the Data Protection Act 2018.
    2. Data will be used for the following purposes:
      1. Lottery administration - for the performance of the lottery contract between the Promoter and the Entrant;
      2. Notification and payment to Lottery winners - for the performance of the lottery contract between the Promoter and the Entrant;
      3. In an anonymised and aggregated form to promote the Promoter, and other commercial partners from time to time of Communication Zap and its group companies - for the legitimate interests of the Promoter, whereby the legitimate interests are the promotion of the Lottery and its charitable causes;
      4. For marketing purposes, such as in the Lottery Newsletter to publish winners - with the consent of the Lottery winner; and
      5. Other purposes listed in the Lotteries Privacy Notice, and updated from time to time.
    3. You have the right to access Data held about you. To obtain this information, please contact us in writing in accordance with Section 10 of the Lotteries Privacy Notice referenced above.
  8. General
    1. Entrants acknowledge and agree that by entering a Lottery, they accept the Rules and they do not rely on, and shall have no remedy in respect of, any statement, representation, warranty or understanding (whether negligently or innocently made) of any person (whether or not such person is a party to the Rules).
    2. The Laws of England and Wales shall govern the interpretation and/or enforcement of these Rules and all parties hereby submit to the exclusive jurisdiction of the English courts.
    3. The Promoter reserves the right to amend or modify these Rules at any time and to withdraw the Lottery and to notify such alteration or withdrawal by such means at any time as it considers appropriate.
    4. A copy of these Rules may be obtained by sending a stamped addressed envelope to the Promoter at the address set out in Section 10 of these Rules.
  9. Complaints and disputes
    1. Any complaints relating to a Lottery should be made in writing and sent to the Promoter at the address set out in Section 10, giving details of the complaint, supporting documentation and details of how the Promoter can contact you to resolve the complaint.
    2. We aim to ensure that any complaints regarding a Lottery are dealt with promptly and in confidence and your complaint will be fully investigated and a response issued within 10 working days.
    3. In the event of any dispute regarding the Rules, the decision of the Promoter shall be final, and no further correspondence or discussion shall be entered into. All complaints or disputes will be dealt with in accordance with our policy ( Lotteries - Social Responsibility in Gambling), a copy of which is available from the Lottery Office. In the event of a dispute not being resolved it will be referred free of charge to an alternative dispute resolution service. As Your Lottery is a member of the Lotteries Council this will be referred to The Independent Betting Adjudication Service Limited (IBAS) www.ibas-uk.com 0207 347 5883.

  11. Regulation
    1. It is an offence for anyone under the age of 16 to participate in a lottery and the Promoter has a statutory duty to verify that members are 16 years old. By becoming an Entrant, you agree to us carrying out any checks that are deemed appropriate to verify this requirement, including if necessary seeking confirmation from relevant agencies that can provide such information. Should a prize winner be found to be under the age of 16 we will refund their money and withhold the prize.
    2. The Promoter is a member of the Lotteries Council www.lotteriescouncil.org.uk and makes a financial contribution on behalf of its members to the Responsibility in Gambling Trust (RIGT), an organisation set up with the sole aim of promoting and encouraging responsible gambling. The Lotteries Council website has a page dedicated to RIGT www.rigt.org.uk and also GAMCARE www.gamcare.co.uk the leading organisation that provides practical help to problem gamblers.   12. Responsible Gambling
    1. Whilst the majority of people do gamble within their means, for some gambling can become a problem. It may help you to keep control to remember the following:
      1. Gambling should be entertaining and not seen as a way of making money;
      2. Avoid chasing losses;
      3. Only gamble what you can afford to lose;
      4. Keep track of the time and amount you spend gambling; and
      5. If you want to have a break from gambling, you can use our self-exclusion set out in Section 5.3
    2. If you are concerned that gambling is becoming a problem for you (or someone else) then the following questions may help you find out:
      1. Do you stay away from work, college or school to gamble?
      2. Do you gamble to escape from a boring or unhappy life?
      3. When gambling and you run out of money, do you feel lost and in despair and need to gamble again as soon as possible?
      4. Do you gamble until your last penny is gone, even the fare home or the cost of a cup of tea?
      5. Have you ever lied to cover up the amount of money or time you have spent gambling?
      6. Have others ever criticised your gambling?
      7. Have you lost interest in your family, friends or hobbies?
      8. After losing, do you feel you must try and win back your losses as soon as possible?
      9. Do arguments, frustrations or disappointments make you want to gamble?
      10. Do you feel depressed or even suicidal because of your gambling?

  13. Your Lottery is aware of its responsibilities to customers and the need to protect consumer funds in the event of insolvency. It is company policy to have separate bank accounts for agents' commission, donations to the beneficiary, prizes and any advance lottery payments. Relevant authorization processes as well as signatory levels are in place across all bank accounts. A separate bank account is also used for all lottery activity.
